Canadian Immigration Appeals

Immigration appeals refers to the process of challenging decisions made by the Canadian Immigration Authorities. These hearings occur before a court or administrative tribunal. This is a type of Canadian immigration litigation that occurs between the applicant and the Canadian Immigration Authorities. Any type of refusal by the Canadian Immigration Authorities can be appealed in the Federal Court of Canada or the immigration appeals division.

If the court decides that an improper decision was made, the case will be sent back to another decision maker. Immigration appeals can be made regarding the following types of applicants: Sponsors, Refugees, and Permanent Residents. Those who choose to appeal their immigration decision are allowed the opportunity to present new evidence to support their case, and also testify in front of a board member.
